What Is The UCPA?

Utah's privacy law, officially known as the Utah Consumer Privacy Act (UCPA), governs how businesses collect, use, and share personal data. Utah residents have the right to know what personal information is being collected about them, to request that it be deleted, and to opt out of having their information sold.

Additionally, the UCPA imposes certain data security requirements on businesses handling personal information. On May 29, 2021, the law went into effect for businesses that meet certain revenue or data processing thresholds.

Who Needs To Meet Compliance With The UCPA?

The Utah Consumer Privacy Act (UCPA) requires certain businesses to comply with Utah privacy law. For-profit businesses subject to the UCPA include:

  • Utah-based businesses; and
  • Those with a gross revenue of more than $25 million per year;
  • Or those who manage or process the personal information of 100,000 Utah residents or households;
  • A company that receives at least 50% of its revenue from the sale of personal data and controls or processes the personal data of at least 25,000 Utah residents or households.
  • UCPA compliance is required if a business meets any of the above criteria. Utah residents have certain rights over their personal data under the UCPA, including the right to know what information is being collected about them, the right to request its deletion, and the right to opt out of its sale. There may be fines and other consequences for businesses that fail to comply with the UCPA.

  • Be familiar with the requirements of the UCPA and how they apply to your business.
